Terms of Service
Meacham’s Rv INC PROVIDES A VARIETY OF SERVICES SUBJECT TO THIS AGREEMENT. BY CHECKING THE BOX OR CLICKING THE BUTTON NEXT TO A LINK TO THIS AGREEMENT ON ANY OF OUR SIGN-UP PAGES, BY EXECUTING AN ORDER FORM OR STATEMENT OF WORK THAT REFERENCES THIS AGREEMENT, BY SIGNING UP FOR AN ACCOUNT, BY LOGGING IN TO YOUR ACCOUNT, BY ACCESSING ANY PART OF THE SERVICES (INCLUDING BY MEANS OF ANY API INTERFACE), YOU, AS A CUSTOMER OF THE SERVICES OR A REPRESENTATIVE OF AN ORGANIZATION THAT IS A CUSTOMER OF THE SERVICES (COLLECTIVELY, “YOU”), REPRESENT AND WARRANT (1) YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS AGREEMENT, (2) YOU ARE AT LEAST EIGHTEEN (18) YEARS OF AGE, (3) THE INFORMATION YOU PROVIDED IN CONNECTION WITH YOUR REGISTRATION FOR THE SERVICES IS TRUE, ACCURATE, CURRENT AND COMPLETE, AND (4) YOU HAVE THE AUTHORITY TO ENTER INTO THIS AGREEMENT PERSONALLY OR ON BEHALF OF THE ORGANIZATION YOU HAVE NAMED AS THE AUTHORIZED USER, AND TO BIND THAT ORGANIZATION TO THIS AGREEMENT. NOTE THAT BY REPRESENTING AND WARRANTING TO THE ABOVE, YOU ARE MAKING A LEGALLY ENFORCEABLE AGREEMENT.
We may change any terms of this Agreement by posting a revised Agreement and the revised Agreement will be effective immediately upon posting or the effective date indicated in the new Agreement, as applicable, and apply to any continued or new use of the Services. We may change the Services, or any features of the Services at any time, and we may discontinue the Services or any features of the Services at any time. If you do not agree with the terms of this Agreement, you must immediately discontinue your use of the Services. Otherwise, your continued use of the Services constitutes your acceptance of such changes. We recommend that you regularly check our website to view the then-current terms.
Use at Own Risk Waiver for Equipment Rental
This Use at Own Risk Waiver (“Waiver”) is made effective as of 5/11/2025 by and between MEACHAMS RV INC (“Rental Company”) and [RENTER NAME] (“Renter”).
1. Assumption of Risk
Renter acknowledges and agrees that the equipment provided by Rental Company (the “Equipment”) may pose risks of injury, damage, or loss, whether inherent, foreseeable, or not. Renter voluntarily assumes all risks, known or unknown, associated with the use, operation, transportation, and possession of the Equipment.
2. Release and Waiver of Liability
To the fullest extent permitted by law, Renter releases, waives, and discharges Rental Company and its officers, directors, employees, agents, affiliates, successors, and assigns from any and all claims, liabilities, damages, losses, actions, causes of action, costs, and expenses (including reasonable attorneys’ fees) for injuries, damages, or losses of any kind arising out of or in connection with the use or misuse of the Equipment, regardless of cause, including without limitation the negligence of Rental Company.
3. Indemnification
Renter agrees to indemnify, defend, and hold harmless Rental Company and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to Renter’s use, operation, or possession of the Equipment, including but not limited to injury to persons or property.
4. Renter’s Responsibilities
Renter represents, warrants, and covenants that:
- Renter has inspected or will inspect the Equipment before use and found it to be in safe and good operating condition;
- Renter will use the Equipment only for its intended purpose and in compliance with all applicable laws, regulations, and manufacturer instructions;
- Renter will not permit any person to use the Equipment unless such person is properly trained and authorized;
- Renter will immediately report any damage to, or malfunction of, the Equipment to Rental Company.
5. No Warranties
Rental Company provides the Equipment “AS IS” and makes no representations or warranties, express or implied, regarding the condition, merchantability, fitness for a particular purpose, or safety of the Equipment.
6. Governing Law
This Waiver will be governed by and construed in accordance with the laws of the State of [GOVERNING LAW], without regard to any conflicts of law principles.
7. Severability
If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
8. Acknowledgment
By checking the box on check out , Renter acknowledges that Renter has read, understands, and voluntarily agrees to this Waiver and its terms.
